Divorce Law – Community property/debt – TX?

I understand about division of community property in Texas; however with regard to debt, I need some info. When debt is created ‘within’ the marriage and husband/wife have credit cards in both their names – courts would judge ‘equal liability’, but if husband had his credit card in His name only, and wife likewise had hers in her name only – would both be held responsible by the courts for that debt too? How would credit card company look at responsibility in case of individual cards?

Lastly, if a school loan taken out during marriage was in only the wife’s name, would the husband also be handle responsible for it …since in the long run, if they had stayed together, the ‘family’ would have benefited?

When a spouse dies do you have to pay his debts?

My spouse died June 3rd from pancreatic cancer. we have separate credit cards in our own names etc…I got a letter from his credit card company stating that who ever is taking over his estate has to pay his bill. I am living in the house because it’s in both names. Do I have to pay his bill even though my name isn’t own his credit company even though I am his spouse?

Proof of final credit card payment?

Hello,

I’m one or two payments away from being free of credit card debt. When I make the final payment, I want an acknowledgement in writing to that effect. However I have a sneaking suspicion that they’re going to be difficult about this, based on a pattern of negative experiences whenever I’ve had to deal with what passes for their Customer Service Department. I was therefore wondering if any of you have found yourselves in a similar situation, and what measures if any you took in order to have an acknowledgement in writing that the debt has been paid in full? Should I send a certified letter with a certified check, or is there a better way to go about this? Are they legally obliged to honor such a request? Is there any consumer advocate group that would be able to help in any way?

I neglected to mention that this card expired in March of 2006. I’ve simply been chipping away at the debt since then, and am now on the verge of paying it off completely.

Mos melodic hypnotic- one would think so, but given their seemingly never-ending supply of surcharges, taxes, penalties, etc- and I’ve been pretty good about paying punctually, particularly in the last year and a half- you never know. Hence my apprehension.

When can civil debts become criminal, no fraud elements. How do they draw the line?

So if you owe the government, it’s criminal, if you owe a non governmental agency it’s civil? With no fraud elements attached, it’s as simple as that?
Is there a dollar amount, how do they figure out when monies owed become criminal?

You owe the credit card company, you avoid jail. You owe taxes, you go to jail. Is it done with a self serving mentality or are there actual formulas for figuring this stuff out?

I know obviously with fraud elements attached it’s criminal.

Can our company collect from old credit card debts?

We operate through a small credit card company which has gone bankrupt. The company never paid us for several charges that were made through the company, so while the customer paid the credit card company, we, as the merchant, never received payment. We are a small business in California. Can we collect payment from the original customer, and if so, do you know what law backs it up?
