I work for an all around financial services company. I offer life, car, & home insurance. I also refinance mortgages without starting people back over at 30 years, get people approved for a purchase of a home loan, debt consolidations, planning for retirement & college savings, as well as offer an oppurtunity for a career with my company. I want to sum all of that up on a car door magnet. Help Please!!!

Walk away? Foreclosure… Any other options? House in GA I had to move to AL House unoccupied?

Okay, so I used to live in GA, bought a house in 2007 no money down. price was 158,000. 2 Mortgages… I had a job change and ended up in Alabama. I make decent money but it is a financial burden to pay rent and a mortgage. I am considering walking away from a house I am not living in I hate to do this.

I have called a financial advisor and he advice foreclosure, short sale or deed in lieu.. I briefly talked to the bank and they might accept the Short S. and Deed in L. But I talked to someone probably not in a decision making position so I must talk to the bank again.

The plan could be walk away, then file for Chapter 13 to repay the debt. But this way I keep my head straight and live a happy life house free. House prices have declined 20% I am unable to sell and looking at a loss of k in 6 months… if I foreclose or do a deed in L. or whateverv else and file chapter 13 that might be better off.. considering that in a yr. the debdt. will be 30k, and 20k per year after that.

How to change a deed for an estate to the names of the heirs?

My sister and I were left a home by our mother in NJ. My sister is the executrix. We went through probate some time ago, but the deed/title was never transferred to us due to poor advice on how things should have been handled. I’m turning over my rights to the home to my sister after it’s finally transferred to both of us from the estate and I know that can be a quitclaim. But before that, the property has to be put in both of our names. What is the best way?

Before someone jumps on me, there is an attorney involved already. However, the attorney drew up a very questionable contract and I’m considering going elsewhere. This attorney has the estate selling the home to my sister for the full value of the home and added a clause indicating that I get half of that. But where does the other half go and why does the attorney have my sister buying something that was left to us in a will as beneficiaries? Also, how can she be purchasing my rights if my name isn’t on a deed? The attorney had my sister do all the usual costly inspections, title searches, etc and wants to do a closing as if this wasn’t a situation where property stays within a family and no warranties or guarantees are being requested or needed. There’s no mortgage, the home is free and clear of all debt, as is the estate.

Isn’t there a simple way to change the names on the deed to reflect our names without all this? I’ve heard estate property is often transferred from the estate to heirs on a quitclaim deed or a personal representative deed without all the usual trimmings involved in a sale between strangers involving mortgages, etc. Is that correct?

And on the quitclaim I would do to turn over my rights, my sister has the money required to buy me out in her hand. She doesn’t need a mortgage. Is it possible to make that amount the amount used for consideration of the quitclaim and call it a day?

Please address all parts of this question and please don’t simply say "get an attorney" because that’s the plan. This is research to avoid having another poor attorney handle this. But if you’re a real estate professional and you know for certain this is a very simple process with minimal legal process, feel free to mention that.
There are no trust issues between myself and my sister. In fact, she insisted on buying me out after I offered to just let her have it.
