Will a "Debt Consolidation " company also help with Ed fund student loans that are now defaulted?

I am considering looking into debt consolidation. My student loans are being garnished by ed fund from my wages. they have also just taken my Ca state income tax check. If I do debt consolidation, will they be able to stop my wages from being garnished?

Bankruptcy in Texas.. Help please?

Ok, I am buried in credit card debt and medical bills and I really need some advice from someone who isn’t biased by trying to sell me their service.

I stopped making the payments on my cards in 2007, and my debt has since gone up over K.

I have looked into consolidation, but they want K a month which I can’t afford. I have already changed my financial habits and gotten rid of the majority of extras, but I still can’t afford it. From what I gather consolidation is only mildly better than bankruptcy.

I am now in the process of filing for bankruptcy to try to clear my name. In fact I have a meeting next week to finalize and file the paperwork. This is going to cost me roughly 00.

1. If I choose not to file bankruptcy, will my debt continue to be re-sold to collection agencies and continue to grow? Is there a limit to this or can they just keep twisting the knife??

2. I have been told that they will try to sue me,and I assume I would likely lose a second house that was willed to me, but what else can they take? What can they do if I sign the house into my brother’s name?

3. I know they can’t take my primary residence or my or my wife’s work vehicle, and I don’t have anything else other than my mom’s house. They can’t garnish my wages but I have been told they can take my tax return? Also, I was told that they could write it off and send me a 1099 that would make me responsible for the debt. Is this true?

4. I keep hearing these commercials about how Obama has changed the laws to help people in my situation, but I think they are just consolidation companies trying to scam me?

Can anyone please help me?

I can ask my lawyer but my lawyer stands to make 2000 so is she biased? I really want to know what happens if I don’t file bankruptcy or make any attempt to pay the debt. Will it continue to be re-sold to creditors and continue to grow? What happens if they write it off and hit me with a 1099?

Gym threatens to give me to a collections agency. What can I do?

I started a membership with Premier Fitness in May 2008 and purchased 36 personal training sessions. They opened 2 accounts for me – one for the regular membership (account A), and one for the personal training (account B). Both accounts are bi-weekly, A is , B is whatever the total is for the PT sessions, divided by 26.

My trainer got fired after I used up 19 of the 36 sessions, so I stopped training with a trainer, as they were supposed to find me a good replacement. They didn’t. 2 months later I got hired as a personal trainer at the gym myself, and I was told that all employees get free membership.

They kept charging my credit card for another month and a half (3 payments), and I tried many times to tell them to update their records and stop, but they didn’t. So, I canceled my card. That, in theory, left another 4 months of gym membership on account A, and whatever was left on account B.

A year and a few months later I get 2 letters, one for each account, saying that I owe about 0 on account A, and 0 on account B (which claims that I also purchased some nutrition package, which I didn’t). I call and from the call it seems that they want me to pay the 0, and "we can deal with the 0 later"… As far as account A goes, I was under the impression that if I’m an employee, I get a free membership, and this will stop. Account B – i signed an agreement to get training and pay for it… considering they never provided me with the service, are they entitled to the balance? I did the math, and the money I had paid to the point when I canceled my card was exactly for 22 sessions, at their hourly rate.

Now they threaten to send me to a collections agency unless I pay them… To add insult to the injury, they owe me over 0 in wages for months now, but they don’t care – they say it’s 2 departments, and to get my wages, I have to start another war. They also want things in writing, but they never provide anything in writing – that gym is one big mess and paperwork is almost impossible to get.

What should I do? What happens if I don’t pay? What can they do to my credit (that other than this would be perfect)? I read something about "debt expiration of 2 year"… are they worried about that so they want me to pay the small one just so the timer gets reset, or am I misunderstanding that?

Any advice would be welcome.

Should I marry my boyfriend for the military benefits?

So here is my situation. I am 19 years old and my boyfriend is 20. We’ve been dating for about a year now and he’s always expressed interest in the military. Just recently he has decided to go active duty in the Army. I’m not worried about his safety as he is smart enough not to pick infantry or other dangerous MOS’s, but he will be gone for four years.

Right now I am in a lot of debt due to teenage irresponsibility and I work 40 hours a week making pretty pitiful wages. I’m enrolled in school part time but I’m really feeling the crunch because I don’t make enough money to take very many credits and it will take me years to earn even my associates.

His idea is for us to marry and for me to travel with him wherever he is based. The pros are that I will be close to him, I will have free housing, insurance, etc. AND I’ll be able to go to school for free/cheap. He tells me that he loves me and he doesn’t want to leave without me and that he’s happy that he can finally be able to take care of me like he should. (He’s recently unemployed and on a suspended license so I’m pretty much his sugar mama.)

However, I feel as if he is planning this without me. He already has our whole lives planned out: that we’re going to see the world, get educated, repair our finances, gain experience and responsibility and after his time is up we’ll come back home and start a life together here.

But here’s my problem. We’ve only been dating a year. I do love him, very much, and I know that he loves me, but I really don’t think we’re ready. We used to fight all the time, and true we’ve resolved those issues, but I still don’t feel that we’re ready for that step. His mother had an idea that we can just tie the knot in court for the benefits and then have an actual wedding ceremony a year or two later when we really feel emotionally prepared for marriage but I’m unsure.

Any advice? I would actually love to go. I’ve lived in the same town my whole life and I’m ready for something new. I’m a bit of a loner so I would do just fine when he’s gone for weeks at a time and I’d love to be able to just attend school and not have to worry about the finances. And I love him so much I couldn’t stand being without him for four years, especially since I’m in this rut right now.

I guess I’m just interested in some objective opinions, as my family is biased against it and his is biased towards it. I’m leaning towards it myself but I’m worried it would be a rash decision. Thoughts?
Oh and for the record, I’m not religous at all so for me marriage is not a "holy matrimony, til death do us part", it’s a legal institution that just so happens to be practiced in our country. Strange maybe, but that’s how I feel. Thank you for your answers so far, though. :)

PLEASE HELP! Respite Care for our children because of chronic depression?

My husband is in the process of getting respite care for our 2 children (ages 4 & 5) so he can go to work.

He makes ,000/yr but we had a huge business loss causing his wages to be garnished which is over 70% of his income. Therefor, we can’t afford daycare and he makes too much to get state pay for daycare.

Our children are both on the Autism Spectrum because I can’t get out of bed and socialize them. I can barley get enough energy to use the bathroom.

My husband found out that we can get free respite care for through the state, but isn’t this a NURSE??? I can take care of myself, it’s my children I’m so worried about. They need interaction with other children, not a nurse. They are 4 & 5 and both of them have social skills as a typical young 2 & 3-year-old child.

I am so worried about our children’s well-being because they have not had any social interaction in their entire lives (except for 4/hrs per week of Early Intervention). Every penny is going towards debt payments, food, rent (we lost our home), and simple necessities. He refuses to file for Bankruptcy since we have already paid 0,000 in debt in the past 3 years and we are down to ,000 in debt (all from a business loss).

I desperately need answers from someone who truly understands "chronic depression" and how debilitating it is and/or someone who knows a little about state assistance for our children in a case like this. My husband makes too much to get state pay for daycare (even though over 70% of our income is going towards debt payments from the business loss).

What is respite care for our children??? I don’t need a nurse, I need someone who can physically care for them by taking them out to the park, zoo, do puzzles, play games with them, and make their meals… like a nanny. Isn’t respite care a home "nurse"???

Justmein: My kids have been in Early Intervention since the age of 3. That is only 2/hrs per day, 2/days per week for our4-year-old and 2/hrs per day, 4/days per week for our 5-year-old. Our 5-year-old will be starting Kindergarten 2.5/hrs per day in September. That is all that is required by the state and most of the country.
Both of our children are in "Early Intervention" and we just had an IEP meeting for our 5-year-old who is going to start Kindergarten this September. Both of them have had IFSP meetings every 3 months from age 3 up until last month for Early Intervention. It’s called Early Intervention in Oregon until the age of 5 and start Kindergarten. I even double checked on that to be 100% sure. I wish I lived in your state so they could receive "full-day" services.

If i just stop making payments on a credit card, can they eventually sue me for the balance?

I have two lines of credit open that total around ,000. The minimum monthly payments became to much for me, after a pay cut and my employer changing my medical decuctions. So, it has been quite a few months now that i havent made one payment towards either of these cards. I have spoken to people from both companies, trying to figure out a way to continue to pay off my debt but the only options they gave me were very un do’able. They wanted half of the balance due, paid in full within 15 days. Well, if i cant come up with a 0 payment every month, what are the chances im going to be able to come up with 00 in 15 days..lol So, my question is this..if i continue to ignore these companies and my accounts get turned over to collection agencies, what happens next? Will the accounts just be at a charge off status, and i’m free of those debts (once the collection agencies stop calling)? I have read that eventually you could be sue’d or your wages garnished, are either of those common for creditors to do? I’ve had so much mixed advice. I know another option is always bankruptcy, but at 28 years old that seems a little ridiculous. Any advice is VERY much appreciated!!
